This is an action to foreclose a deed of trust on real property executed by Margaret Kitching Perky in favor of respondent Margaret Steiner to secure a promissory note for $10,000. In the circumstances hereinafter related the deed of trust and note were purportedly assigned to plaintiff by Miss Steiner to secure a loan for $3,000. From a judgment cancelling and annulling the assignments and refusing plaintiff's plea for foreclosure, this appeal is taken.
